How long does divorce take in Switzerland?

Switzerland has two types of divorce: joint application and unilateral claim. Duration differs greatly depending on which applies.

A joint divorce may take 1 to 6 months if the spouses agree quickly and submit a complete divorce agreement.

This is not possible with a unilateral claim. Two years of actual separation must precede filing. The sole exception is unreasonableness of continuing the marriage, subject to very high thresholds. Proceedings also take longer because the court must decide divorce consequences and the other spouse often tries to delay them.

In short: If you file jointly and ideally already agree all consequences in a complete divorce agreement, divorce may be completed in around 1–6 months.
