What if my husband or wife refuses divorce? Can I still divorce?

If only one spouse wants divorce, this does not make it impossible. It will, however, take longer than if both agree that divorce is the next step.

This means that if your spouse refuses divorce, you must be actually separated for at least two years before filing a claim at the court where either of you lives. Earlier filing is possible only if waiting through separation cannot reasonably be expected, for example because your spouse physically or sexually abuses, harasses or stalks you.
